Part 1: For this presentation, you will create a 6-8-minute video of the fact that vaccines are safe and effective. Lawmakers are divided over legislation that permits the U.S. government to surveil noncitizens overseas without a warrant, known as Section 702 of the Foreign Intelligence Surveillance Act (FISA). The legislation, set to expire last December, allows the National Security Agency (NSA) to collect communications of foreigners who are located outside the U.S. and have been deemed intelligence targets. Critics argue that this legislation threatens the civil liberties of Americans, as some of the communications collected could be about or with U.S. citizens, allowing the government to track Americans through those communications.
Those in favor of the legislation argue that it is critical to the nation’s security, as losing this vital provision would raise profound risks. The National Counterterrorism Center (NCTC) also expressed concern about the potential loss of Section 702, stating that it is essential for finding and disrupting serious security threats.
Groups like the American Civil Liberties Union (ACLU) have voiced concerns that not reforming Section 702 could lead to “backdoor” surveillance on Americans. They pointed to examples of the FBI using Section 702 to conduct searches on Americans’ communications around racial justice movements and protests, as well as to surveil journalists and members of Congress.
The House Judiciary Committee bill proposed by the ACLU would reform Section 702 to require federal agencies to obtain a warrant before conducting queries on U.S. citizens and ensure accountability for those who violate the civil liberties of Americans. However, the “Queen of the Hill” showdown vote was postponed until 2024, and FISA approval was extended until April 2024 to give lawmakers more time to come to an agreement on a best path forward for Section 702.

The answer is a resounding NO. The debate over whether the U.S. military or other federal agencies should conduct surveillance within the U.S. without a warrant is highly contentious, raising significant constitutional and ethical concerns. Unwarranted surveillance violates constitutional protections and threatens civil liberties. The National Security Agency’s (NSA) mass data collection program, revealed by Edward Snowden, highlights the dangers of unwarranted surveillance and the potential for misuse. The USA PATRIOT Act expanded the government’s surveillance powers, allowing broader data collection without traditional warrants under the Foreign Intelligence Surveillance Act (FISA). Recent disclosures by the Justice Department Inspector General underscore these worries. Michael Horowitz’s report on the FBI’s handling of the Trump-Russia investigation revealed significant errors and omissions in the FBI’s FISA applications (Washington Examiner, 2024). These findings emphasize the potential for abuse in the absence of rigorous oversight and legal protections. What about outside of the United States at any time on American citizens?
Surveillance of U.S. citizens, both within the country and abroad, should always require a warrant to protect their rights. The Supreme Court has recognized that U.S. citizens have constitutional rights abroad (Reid v. Covert, 1957). Despite the Fourth Amendment’s limitations outside the U.S., U.S. citizens have constitutional rights overseas. Unauthorized surveillance can lead to privacy breaches and diminish trust in the government. While Executive Order 12333 (1981) aims to protect national security, it grants broad surveillance powers that can be exploited. Balancing national security and individual rights is crucial, and it is essential to ensure transparency, accountability, and compliance with constitutional principles to maintain trust and uphold democratic values.
Should the various law enforcement agencies found at state and local levels be able to conduct surveillance and collection within the United States when they have a warrant, but also be able to do it when they do not have a warrant?
State and local law enforcement bodies also grapple with reconciling effective law enforcement with respect for constitutional rights. The necessity for a warrant, grounded on probable cause and issued by an impartial judge, is a fundamental aspect of American legal safeguards against random government interference (Illinois v. Gates, 1983). Permitting law enforcement to carry out surveillance without a warrant weakens these safeguards and opens the door to significant power abuses. There exist situations, such as urgent cases, where the courts have acknowledged exceptions to the warrant requirement (Brigham City v. Stuart, 2006). These exceptions are strictly defined to ensure that pressing situations can be managed without infringing on constitutional rights. However, broadening these exceptions to permit routine warrantless surveillance by law enforcement would undermine fundamental civil liberties and establish a perilous precedent.

Response #1 (Powell): Hello Everyone, For this weeks discussion, I have chosen Executive Order 14120 as the doctrine in which I can agree and Executive Order as the one I disagree with. Executive Order 14120 was published on behalf of the First Lady of the United States and the Biden administration as a means to counteract lackluster women-specific health research methods which, according to this Executive Order have long been in place. Many of the medical advancements that face out modern society originated around men. After having two relatives suffer from conditions such as PCOS and cervical cancers, it is tempting to believe that medical research for women is inadequate, and could a serious revision. Many doctors will emphasize their work as “practice” and this is often due to our limited understand of medicine as it pertains to absolutes and cures. With the the vast physiological differences between men and women, the need for female specific medical practice is beyond overdue, thus earning my concurrence. Executive Order 14092 was set in motion to reduce gun violence. I feel as if it is important to address this from the same administration to emphasize my neutral stance on politics. Gun violence is a significant problem in the United States, without question. Gathering analytical data to support both sides is easily accomplished. This Executive Order seeks to reinforce the Biden administrations stance on assault weapon and high capacity magazine bans. As someone who has been in law enforcement for more than 10 years now, I can confidently say that the vast majority of violence that plagues our society is not from these high capacity magazines and assault weapons, but rather, handguns. I have taken an obscene amount of these weapons from convicted felons, minors, in conjunction with narcotics, etc. and have seen first hand how this Executive Order misses the mark. After living in Europe for a period of time, I have learned that the total withdrawal of guns, does not equate to less violence. Violence will find a way if desired and sought after by someone. I disagree with the bans mentioned in this Executive Order as actions should be taken to increase punishment for those who disobey (significantly) as the repercussions, while they vary state to state, are often inadequate when seen objectively. Creating a system tailored to reducing crime rather than monetizing it should be the best temporary solution until change on a larger scale can be made. I hope you all have a great week!

Response #2 (Brian): For this discussion, I chose to write about Executive Order 14113 – one which I agree with. This Executive Order, signed by President Biden on December 26, 2023, makes an adjustment to certain rates of pay within the Government. This Executive Order is usually signed by the sitting President every year just before the end of the calendar year. This Executive Order gives pay raises to Government employees. It is designed to ensure that the salaries of Federal employees remain fair and consistent with the rate of inflation and the competitive market. One reason why I strongly agree with this order is that it is what gives the uniformed military members a pay raise every year. With the rising costs of goods and services, it is extremely difficult for many military members to make ends meet. This Executive Order, while not a complete solution, gives military members and federal employees the chance to keep up with the economy and ensure that they can afford the basics of living.
One Executive Order that I don’t necessarily agree with is Executive Order 14043. This Executive Order, signed by President Biden on September 9, 2021, made it mandatory for all federal employees to receive the COVID-19 vaccine. I do not agree with this Executive Order because I feel that it infringes upon the employee’s rights to decide what type of medical vaccine and treatment they want to receive. I don’t think that the government should have made this a mandatory requirement. At a time when people were financially suffering and there were many unknowns, people did not want to lose their jobs or face reprimand because they refused to get the vaccine. This Executive Order was later revoked through Executive Order 14099, where government employees were no longer required to receive the vaccine. While the COVID era was confusing and a learning opportunity for everyone, I strongly believe that Executive Order 14043 was unnecessary and did not allow American citizens to make choices on what to do with their own health and body.

Article Summary: In this class you will be writing a paper which will describe a specific issue area and a set of activities
undertaken by global organizations to address the issue. The first step in this process is to select an issue
area and to familiarize yourself with it by finding and describing a current article that addresses it.
After selecting an issue of interest to you, find a news article from a reputable source, and summarize the
article. Please see Handout “Respected News Sources” to be found in the Weekly Course Materials tab.
This handout is in the folder for the session labeled “Introduction-9/3/20.” This handout contains some
news outlets that are known for using formal sources of information in their reporting and are widely seen
as reputable and reliable. You may use other sources since the list provided is not complete but be sure
they are sources that use information from formal and varied sources.
In your summary address the following questions:
What is the issue addressed by the article? Very briefly describe the nature of the problem. Use
concrete examples offered in the article such as:
o Where is the problem taking place?
o Who is affected by it?
o What are the consequences for the affected individuals?
o Their community?
Does the article cite an organization that is addressing the problem? If so, what is this
organization and what are they doing? Do you think they are doing a good job?
What is your reaction to the article (e.g. surprise, insights, anger, helplessness, optimism,
ambivalence, fear, feelings of inspiration?) Explain your reactions.
