  • Title: Understanding and Applying OSHA’s Hazard Communication Standard in the Workplace

Select one standard discussed in this course. Then, write an essay that addresses the following elements:
Discuss the purpose of the standard, who it affects, and who is excluded.
What are the key elements of the standard?
Select and summarize a letter of interpretation for the selected standard.
List some commonly cited provisions of the standard.
Explain ways the selected standard can fit into a safety and health management program.
Summarize enforcement procedures for the standard.
Create a fictional workplace scenario, and apply the standard. Be creative. Describe a situation in a workplace, and then explain how the standard relates to it and why the standard is important in the situation.
Your essay must include an introduction, and it must flow smoothly from topic to topic. It must be at least four pages in length, using at least two references. One of which should be from the CSU Online Library. All sources must be cited in the text and on the references page using APA Style.

  • Title: Duty of Care and Occupational Health and Safety in the Workplace: A Legal Analysis

    Question 1
Employers owe employees a duty of care to provide a safe system of work. Explain what this means, referring to relevant Australian legal cases and practical examples to support your response. (15 marks)
Question 2 (this question may be informed by your answer to Question 1, but is separate from the above)
Doug was employed as a carpenter. He is reliant on only one eye for his vision as he suffered a hereditary defect in the other eye. His regular duties included maintenance and building repair work. One day he was asked by his employer to do some timber milling work. Whilst using the mill for the first time, (with no safety equipment or training provided) a small piece of timber flies into the eye that Doug uses for vision. Despite attempts medically to save the eye, Doug ends up blind. Identify the legal issues arising from the facts and advise Doug, referring to occupational health and safety issues. (15 marks)
In writing your response, ensure that you answer the questions posed in this document, addressing the criteria in the Criterion-Referenced Marking Rubric (below). In brief, students will be assessed on the depth of discussion provided on the topics and issues, supported by reference to relevant theory and discussion of law. The clarity, coherence, and quality of the discussion advanced is important and most marks are given for analysis; very few marks will be given for merely restating information (including the facts).

  • “Reducing Our Household Footprint: A Waste Reduction Plan”

We will practice waste inventory and then producing a Waste
Reducation Plan by utilzing our own environmental footprint from our
household environment. First we must find out what is our waste or
elements of our footprint. Just like factories or job sites we have
fuels/utilities that are used. For our household environment we may have
natural gas or propane, electricity, water, sewage, etc. We could
categorize these as Utility/Fuels—-or divide between resources (fuels,
electricity, etc) and Utilities like water/sewage. We usually have
monthly bills that show use and cost. We can measure our use over the
next month by what is reported on our bill—millions of cubic feet of
natural gas for example, or gallons of water.
Now in our garbage we might have paper/cardboard, plastic bottles,
glass, food, etc. Now we can measure specifically, but we might count
all of this as “household” waste and then measure it by weight or by
volume—lets be practical and measure by number of 13 gallon bags (so
we dont weigh) We can track our use over the next month.
Now we can research how to reduce our footprint. We use the three
R’s—-reduce, recycle, reuse. We can plan for water reduction by
planning to replace a drippin gfaucet for example. We can reduce fuel
use in vehicles by using nitrogen on our tires, or using more efficeint
air filters. We can plan to recycle cardboard.
Now this is simple—-but the concept is the same in an industrial
setting. It gets more complicated and we can discuss in the DB. Zero
Landfill means that we reduce our wastes by 90% percent that go to
landfill. So mapping our wastestreams is important. In industry we try
to find an alternate market for what would otherwise be “waste”. We can
sell as a “byproduct” and avoid counting it as a waste. Example: in the
olden days we used “creosote” on our fence posts. Not e real friendly
substance. So paint producers like PPG were dealing with sludges and
residuals when they cleaned out tanks of various paint colors. Rather
this being a waste, they collected it, mixed it, and it is a byproduct
that is used as a fence coating (buy in Tractor Supply) If you look at
it closely it has flakes of various colors in it, but hwne mixed are
    black overall.
So our project that we may submit after a month of tracking and
chance to get a utility bill will be to use the inventory sheet design
from the power point and the reduction plan to practice this. Idealy we
would then track the results of our plan and show the difference over
    time.
In industry sometimes this is hidden in cost reduction committees.
For example one year we replaced our large bay doors with ones that
would raise and lower very fast. We tracked the reduction of natural as
used in the winter for heat and a way to measure reduction of
    footprint.

  • Negligence in Physical Therapy: A Case Study Analysis Verdict: Plaintiff Explanation: Based on the information provided in the case study, my verdict would be in favor of the plaintiff. In order to prove negligence, the plaintiff must establish four

After reading the following case study who would your verdict be for, the plaintiff or the defendant? Using your knowledge of what is required to prove negligence explain your verdict.
“The plaintiff, age sixty-nine, was undergoing treatment of osteoarthritis with pain from the lower back and derangement of his left knee. The plaintiff claimed that in June 2003 a physical therapist stretched and injured the left knee by improperly manipulating the knee. The knee was iced and leg-press exercises were prescribed, but the plaintiff claimed that the exercises aggravated his injury. Three days later the plaintiff went to a physician. He later underwent an MRI scan which revealed tears of the posterior horns of the left knee’s lateral and medial menisci. The plaintiff underwent about two and one-half months of additional physical therapy at the center.
The plaintiff alleged negligence in the treatment of the knee.
The defendant claimed that there was no negligence and that the MRI scan showed long-standing degenerative injuries which pre-existed the treatment.”
