    (1) A number of other states, including Australia, Canada, South Africa, and the United Kingdom, have codified the restrictive theory of sovereign immunity. However, the shift from the absolute to the restrictive theory of immunity is hardly universal; China, India, Indonesia, and Russia, among others, still adhere to the absolute theory of immunity. What factors might prompt states to adopt the restrictive theory?
    (2) What justification does the ICJ give for privileging Germany’s sovereign immunity over Italy’s ability to exercise jurisdiction over acts on Italian soil? What normative principle supports the finding that Germany’s sovereign immunity should take precedence over the right of Italian citizens to recover for widespread violations of core international legal norms? Note that, in analyzing the customary international law of sovereign immunity, the Court observed:
    “the rule of State immunity occupies an important place in international law and international relations. It derives from the principle of sovereign equality of States, which, as Article 2, paragraph 1, of the Charter of the United Nations makes clear, is one of the fundamental principles of the international legal order. This principle has to be viewed together with the principle that each State possesses sovereignty over its own territory and that there flows from that sovereignty the jurisdiction of the State over events and persons within that territory. Exceptions to the immunity of the State represent a departure from the principle of sovereign equality. Immunity may represent a departure from the principle of territorial sovereignty and the jurisdiction which flows from it.”
    (3) Are you persuaded by the Court’s statement that permitting an exception to sovereign immunity for serious violations of human rights law would require a court “to hold an enquiry into the merits in order to determine whether it had jurisdiction”? If so, does the same argument apply to permitting a commercial activity exception to sovereign immunity?
    (4) Sovereign debt restructuring is a recurrent issue and repeatedly reveals the need for an organized restructuring process. Some observers propose the addition of clauses permitting a super-majority of bondholders approve a debtor’s restructuring proposal. This approval would bind all bondholders, eliminating the possibility of hold-outs. Others propose creation of a treaty-based international bankruptcy regime, which would permit states to discharge their debts. As among contract, treaty, or politics, which do you think is the best approach to the problem of sovereign debt restructuring?
    (5) Can the judgments of the ICJ and the Italian Constitutional Court be harmonized? Can you justify judicial outcomes finding that international jus cogens norms cannot displace international legal immunities from jurisdiction, but fundamental constitutional rights can?

  • “The Thrill of Victory on the Soccer Field: My Favorite Place in Nigeria”

    My favorite place was the soccer field back home in Nigeria. It was where I felt at my happiest because of the ability I had back then playing soccer and being around my friends while we all played soccer, being competitive and also loving the fast game of football like we call it out there. The atmosphere was always at its best when it rained because we could get wet as kids and still play the sport we loved so much. The amount of goal I scored always mattered to me because I wanted to be the best player among my friends. I remembered we had to play an inter-school match with a different school and they were beating us 3-0 and it was a match we had to win for bragging right to prove that our school was the best in the district. I feel the anger of being laughed on by the students from the other school. So I took the game so seriously and played one of the best games of my life till date scoring four goals in the space of 15mins to win the match and two minutes towards the end of the game I got snubbed off and I got a standing ovation from the whole school and till this day i remember how I felt, what the field looked like, how it smelt like and the emotions that I went through that whole game.

  • Title: Exploring the Implications of a Social Policy: A Case Study

    Objective:
    The purpose of this assignment is to investigate a social policy with some depth and explore the implications of that policy. This paper requires research on the policy itself as well as the historical era and events surrounding the development and implementation of the policy. You will also include a discussion of the intent, target(s) (behavioral and/or individual), ideologies, and impacts of the policy. Lastly you will evaluate the effectiveness of the policy (based on others’ research) and/or present an alternative policy or strategy to meet the policy’s stated goals.
    Format:
    The paper should cover the following 5 areas:
    Identify a social policy
    Provide some historical context of the policy (what was happening around this time and location) – was it during the progressive era, welfare reform era, etc.
    Describe the social policy: how did the policy come to be? What social problem was it set up to solve? What was the target population or behavior of the policy? What were the eligibility criteria of the policy and what were the benefits and/or burdens of it?
    Analyze the values (e.g. equality of opportunity) ideologies (protestant work ethic, paternalism, individualism, etc.) and/or moral theories (e.g. liberalism, Marxism, etc.) driving and/or supporting this policy.
    Discuss the extent to which this policy achieves its aims and consider alternative strategies to achieve the goals of this social policy.

    Describe your sample and your sampling method.
    Explain the 4 steps of the research process you followed.
    Define the critical value and the test statistic your analysis provided.
    Include your scatterplot and correlation findings from Part A.
    Provide the main finding of the study. What did you prove or fail to prove?
    Provide recommendations based on your findings.
    Each slide must have 4 to 5 bullet points with 4 to 5 words for each point plus speaker notes. The bulk of your explanation will go in the speaker notes. This is where you will write and put what you would say when giving this presentation to your audience. This is an academic presentation; therefore, keep the bells and whistles to a minimum and make this a clean, professional-looking presentation. It is a visual presentation, so tasteful and related images are appropriate.
    Format any citations in your presentation according to APA guidelines. Also, if photos are used, they need to be referenced according to APA guidelines.
