Title: Discrimination in the Workplace: Understanding Disparate Treatment, Disparate Impact, and Hostile Work Environments under Title VII of the Civil Rights Act of 1964
Please answer the following questions in 200 words or more. Place the essay answer in the submission box as a single Word Doc by Sunday at 11:59 a.m. Generally speaking there are three primary ways of discriminating under Title VII of the Civil Rights Act of 1964: disparate treatment; disparate impact; and hostile work-environment. The below case specifically describes a case of disparate treatment of a Muslim job applicant by Abercrombie & Fitch. Describe the facts of the case and state your understanding of the Court’s rationale in finding there was disparate treatment. Further, change the circumstances around and create your own facts describing a scenario in which the plaintiff experienced disparate impact discrimination, and another scenario in which you can assume this person is hired, but then experiences a hostile work environment. Under which facts could that scenario exist? EEOC v. Abercrombie & Fitch Stores, 575 U.S. 768 (2015). This case can easily be found on Westlaw, the U.S. Supreme Court website, or the Internet.
Keep the following in mind when drafting your essay:
1) When addressing legal opinions, use the IRAC method. IRAC stands for Issue, Rules, Analysis (sometimes referred to as application), Conclusion. Discussing an opinion using an IRAC will ensure that you address the relevant aspects of each opinion. 2) Write the essay in a manner where it is clear you understand the concept. Repeating concepts from the text does not illustrate to me that you understand the material. The best essays will include an example or illustration of the concept discussed.
3) NO PLAGIARISM! Remember that, even when discussing case law or information from the text book, you must quote and cite any material taken directly from the case. As a general rule, keep quotations to 10% or less and paraphrase all other relevant information.
